CCPA Privacy Notice

1. Information We Collect

We collect information that identifies, relates to, describes, or can be reasonably

linked with a Consumer or household (“Personal Information“).

Personal Information does not include:

• Publicly Available Information or lawfully obtained, truthful information that is a matter of public concern. Publicly Available Information means (i) information lawfully made available from government records (ii) information a business reasonably believes is lawfully made available to the general public by the Consumer or from widely distributed media (iii) information made available by a person to whom the Consumer disclosed it without restricting it to a specific audience.
• De-identified or aggregated Consumer information
• Information excluded from the CCPA’s scope, including health information covered by HIPAA or CMIA, and information covered by sector-specific privacy laws (FCRA, GLBA, FIPA, Driver’s Privacy Protection Act)

We have collected the following categories of Personal Information from Consumers within the last twelve (12) months:

We obtain the categories of Personal Information listed in the table above from the following categories of sources:

• Directly from You. For example, (i) if you visit our websites, respond to a survey, participate in a telephone interaction, fill out a registration form, subscribe to a newsletter, or otherwise agree to become a Member (as defined in our Privacy Policy) of Informa TechTarget (ii) if you fill out a form or communicate with us through one of our websites to receive information about our business to business services or to schedule a demonstration of our online, media, marketing, or data services products or programs, and (iii) if you expressed interest in being contacted by us at a trade show in which we participated or hosted.
• From Automated Technologies on Our Websites. We collect information through cookies, web beacons, pixels, and similar tracking technologies that automatically gather data about your browsing behavior, device information, IP address, and interactions with our websites and content. This includes analytics tools that help us understand how visitors use our websites.

• Directly from our Clients or their agents. For example, from documents or files that our Clients provide to us including, but not limited to, suppression lists/do not call lists and IP addresses corresponding to individuals who have either opted-out of Client communications or who have visited Client’s websites, or related to the products or services our Clients are purchasing from us.
• Indirectly from our Clients or their agents. For example, through information we collect from our Clients in the course of providing services to them.
• Directly and indirectly from activity on our websites. For example, from observing your actions on our websites or through your submission of an online form requesting a demonstration or walkthrough for one of our products or services.
• From Service Providers. We receive information from vendors and partners that support our business operations, including those that help us build contact lists, supplement or update your information in our database, verify the accuracy of our records, or provide technology and analytics services.
• From Third-Party Data Providers. We obtain information from B2B contact data providers, marketing partners, and other third parties (including other B2B contact providers) that integrate their services with ours, provide us access to their databases, or may contact you on our behalf to provide relevant content or membership opportunities.

4.  Sensitive Personal Information:

We collect the following categories of sensitive Personal Information:

• Account log-in credentials (username and password) for your member account
  

We do not collect precise geolocation data (GPS coordinates accurate to within 1,850 feet). We only collect your IP address, which provides approximate location information at the city or state level. This is not considered sensitive Personal Information under the CCPA.

How We Use Sensitive Personal Information:

We only use your account credentials for the following purposes outlined above, which are permitted under the CCPA and do not trigger your right to limit use and disclosure.

5. Sale or Sharing of PI of Children

We do not knowingly sell or share information of Consumers who are under 16. See Section 22 of our Privacy Policy for additional details.

6. Your Rights and Choices

The California Privacy Rights Act (CPRA), which amended the CCPA, provides California Consumers with specific rights regarding their Personal Information. This Section describes your CCPA rights and explains how to exercise them.

A. Right to Know and Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection, use, disclosure, sale, or sharing of your Personal Information over the past 12 months.  Once we receive and confirm your verifiable Consumer request, we will disclose to you:

1. Categories of Personal Information collected: The types of Personal Information we collected about you (e.g., identifiers, commercial information, internet activity)
2. Sources of Personal Information: The categories of sources from which we collected your Personal Information (e.g., directly from you, from our clients, from third-party data providers)
3. Business or commercial purposes: Our business or commercial purpose for collecting, selling, or sharing your Personal Information (e.g., to provide services, to personalize content, to sell to our clients)
4. Categories of third parties: The categories of third parties with whom we share your Personal Information (e.g., our clients, service providers, advertising partners)
5. Specific pieces of Personal Information: The specific pieces of Personal Information we collected about you

B. Right to Delete

You have the right to request that we delete the Personal Information that we collected from you, subject to certain exceptions. If you request deletion of your Personal Information (i) you will no longer be able to log in to Informa TechTarget websites or access Member-only content across all of our brands (ii) we will remove you from all marketing and newsletter lists and (iii) we will delete records of content you downloaded, webinars you attended, and pages you visited. Once deleted, we cannot recover your data or restore your account.

We may deny your deletion request if retaining the information is necessary for us or our Service Providers and/or Contractors to:

1. Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
3. Debug products to identify and repair errors that impair existing intended functionality.
4. Exercise free speech to ensure the right of another Consumers to exercise their free speech rights, or exercise another right provided for by law.
5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the achievement of the research, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with Consumers expectations based on your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

C. Correction

You have the right to request that we correct inaccurate Personal Information that we maintain, or which pertains to you.

D. Right to Limit Use and Disclosure of Sensitive Personal Information

This right does not apply to Members because we only use Sensitive Personal Information for purposes permitted under CPRA § 1798.121(b), which do not trigger your right to limit use and disclosure.

We only use Sensitive Personal Information (account credentials and IP address-based location data) for purposes permitted under California law:

1. Account authentication and security
2. Fraud prevention
3. Legal compliance

These permitted uses do not trigger your right to limit under CPRA § 1798.121(b).

E. Right to Opt-Out of Sale or Sharing

If you are 16 years of age or older, you have the right to direct us not to sell or share your Personal Information at any time .

How We Sell or Share Your Personal Information:

As described in Section 3 of this Privacy Notice, we sell or share your Personal Information with our clients (technology vendors and service providers) so they can contact you with information about products and services tailored to your professional interests.

Important Consequences of Opting Out:

If you opt out of the sale or sharing of your Personal Information, you will not be able to maintain your Member account or access our Premium Services.

F. Right to Opt-Out of Automated Decision-Making

You have the right to opt out of automated decision-making technology, including profiling, that produces legal or similarly significant effects concerning you. This right does not apply to Informa TechTarget users because we do not use automated decision-making technology that produces legal or similarly significant effects.

G. Right to Non-Discrimination

You have the right not to receive discriminatory treatment by our business for the exercise of privacy rights conferred by the CPRA. We may choose in the future to offer you certain financial incentives permitted by the CPRA that can result in different prices, rates, or quality levels. Any CPRA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects.

H. Other California Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our websites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. I. Exercising the Right to Know, Access, Transfer, Correction and Deletion Rights

To exercise the right to know, access, transfer, correct, and/or delete your Personal Information in order to exercise the rights described above, please submit a verifiable Consumers request to us using one of the following options:

Only you or a person acting on your behalf who you authorize (a.k.a. an “Authorized Agent”), may make a verifiable Consumers request related to your Personal Information. We will use reasonable methods to verify your request or that of your Authorized Agent including, for example, comparing the email address you used to register on TechTarget or affiliated third party website.

J. Information for Authorized Agents – Authorized Agents who have the regulatory authority to submit a request may use Informa TechTarget’s Authorized Agent Portal available here to submit CPRA related rights requests on behalf of California Consumers from whom they have received prior authorization to act on their behalf. In order to ensure the security of Consumer’s Personal Information, TechTarget asks that all requests from Authorized Agents be submitted via this method. Evidence of a signed authorization to act on the behalf of the California Consumer that is the subject of the request, should be submitted as a PDF as part of this process. Authorized Agents must also attest to their legal authority to submit information on the behalf of each individual they represent.  Please note, if an authorized agent is unable to provide proof of authorization, their request may be rejected.

Providing missing or inaccurate Personal Information on behalf of the individual you are representing may also result in the request being denied, unless that information is promptly corrected by the Authorized Agent.

You may only make a verifiable Consumer request for certain information (required by Sections 1798.110 and 1798.115 of the CCPA) twice within a 12-month period. The verifiable Consumers request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.  Making a verifiable Consumers request does not require you to create an account with us.  We will only use Personal Information provided in a verifiable Consumers request to verify the requestor’s identity or authority to make the request.

K. Response Timing and Format

We endeavor to respond to a verifiable Consumers request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to the email address associated with that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide may only cover the 12-month period preceding the verifiable Consumers request’s receipt. The response we provide will also explain the reasons why we cannot comply with a request, if applicable. For data portability requests, we will endeavor to select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable Consumers request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

L. Personal Information Sales/Sharing Opt-Out and Opt-In Rights

If you are sixteen (16) years of age or older, you have the right to direct us to not sell or share your Personal Information at any time. Our business, as a B2B provider, is targeted to business professionals. Therefore, we do not collect, sell or share the Personal Information of Consumers we know are less than sixteen (16) years of age.  If we learn that we have inadvertently collected the Personal Information of someone under the age of 16, we will immediately terminate the associated account and delete any data in connection with such registration and the user’s activity.

Consumers who opt-in to Personal Information sales may opt-out of future sales or sharing of their Personal Information at any time.

In order to provide you with our services, it is necessary for us to provide and personalize ads, content, and communications based on your use of websites, including with information regarding your interests and your online interactions. If you request that we “do not sell” your Personal Information, as described in this Privacy Notice for California Residents (and our Privacy Policy), you will not be able to use any services we offer that require the continued use of the your business email address, such as maintaining your member account and providing you access to our free Premium Services. Accordingly, members who utilize the “Do Not Sell or Share My Personal Info” link on our websites will be presented with the option to delete their account with Informa TechTarget and their associated Personal Information. If you make this request, you will still be able to access all the information and content that we offer on our websites to non-members. Further, you may register a new account with our websites at any time using a new corporate email address.
